Please read these Terms of Service ("Terms") carefully before using the Asistan mobile application and related services (the "Service"), operated by Asistan ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

Asistan is a tender monitoring platform that aggregates publicly available procurement notices from government and institutional websites. We use artificial intelligence to match these notices against your configured keyword profiles and notify you of relevant opportunities.

• We do not guarantee the accuracy, completeness, or timeliness of any tender listing.
• Tender deadlines and details should always be verified on the original source website.
• We are not a party to any procurement process and do not process bids or applications on your behalf.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for safeguarding your password and for all activities under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Scrape, crawl, or otherwise extract data from our systems in an automated manner without authorization.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any portion of the Service.
• Use the Service for any illegal or unauthorized purpose.
• Submit false or misleading information in keyword profiles or account details.

5. Intellectual Property

• The Asistan app, logo, and all original content are the property of Asistan and are protected by applicable intellectual property laws.
• Tender listings are aggregated from public sources. We do not claim ownership over the original content.
• You may not reproduce, distribute, or create derivative works from our software or branding without express written permission.

6. Credits & Fair Use

• The Service operates on a credit system for certain premium features.
• Credits have no cash value and are non-refundable except where required by law.
• We reserve the right to modify pricing and credit allocations with 30 days' notice.

7. Limitation of Liability

• The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We are not liable for any missed tender deadlines, lost business opportunities, or financial losses arising from use of the Service.
• In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

8. Termination

• You may terminate your account at any time through the app's Settings screen.
• We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.
• Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
